Estas respuestas y actitudes contradictorias de- muestran la volatilidad de las percepciones y de los discursos y su impacto en la construcción de políti- cas migratorias y de refugiados. ¿Representa este momento de cohesión europea la oportunidad para avanzar en la construcción de una política europea más centrada en valores hu- manitarios? Repensar la solidaridad europea El pacto de los 27 para garantizar la protección automática temporal es un paso muy significativo. Es el momento de repensar la solidaridad europea –hasta ahora dominada por intereses nacionalis- tas y agendas gubernamentales discriminatorias– y avanzar en la política migratoria y de refugiados en la UE. La continua situación de emergencia en las fron- teras europeas ha dejado el Nuevo Pacto Migratorio de la UE, aprobado en 2020, en papel mojado. Un pacto que no ha sido audaz y que refleja políticas anticuadas que no dan soluciones a los problemas en las fron- teras. Hace falta un marco estructural para la migra- ción, que vaya más allá del control fronterizo y de se- guridad, y de la contención en los países vecinos y de origen. La protección de los Derechos Humanos En este sentido, los Pactos Mundiales de la ONU –Pacto Mundial sobre los Refugiados y el Pacto Mundial sobre Migración– deben inspirar la res- puesta de la UE, ya que es en su propio interés esta- blecer a nivel comunitario la obligación inequívoca de respetar, salvaguardar y promover la intersección entre los derechos fundamentales y la protección de los refugiados que recogen las Naciones Unidas. Sin embargo, no podemos olvidar que República Checa, Hungría y Polonia no han ratificado estos pactos. Una visión centrada en la seguridad humana ofrece un análisis interseccional que nos posibilita el desarrollo de estrategias y políticas transversa- les, que permitan mejorar las estructuras de gestión migratoria, garantizando los derechos humanos de los migrantes, independientemente de su estatus, así como una seguridad garantizada en las fronteras europeas. These contradictory responses and attitudes reveal the volatility of perceptions and discourses and their impact on the construction of migration and refugee policies. Does this moment of European cohesion represent the opportunity to advance in the construction of a European policy more focused on humanitarian values? Rethinking European solidarity The pact of the 27 Member States to guarantee temporary automatic protection is a very significant step. It is time to rethink European solidarity –hitherto dominated by nationalist interests and discriminatory government agendas– and advance migration and refugee policy in the EU. The continuous emergency situation at European borders has turned the EU’s new Migration Pact, approved in 2020, into a dead letter. A pact that was not audacious and that reflects antiquated policies that do not provide solutions to the problems at the borders. A structural framework for migration is needed, which goes beyond border control and security, and containment in neighboring countries and countries of origin. The protection of human rights In this sense, the UN Global Compacts – the Global Compact on Refugees and the Global Compact on Migration – should inspire the EU’s response, since it is in its own interest to establish at the Community level an unequivocal obligation to respect, safeguard and promote the intersection between fundamental rights and the protection of refugees collected by the United Nations. However, we cannot forget that the Czech Republic, Hungary and Poland have not ratified these pacts. A view focused on human security offers an intersectional analysis that enables us to develop cross-cutting strategies and policies that allow us to improve migration management structures, guaranteeing the human rights of migrants, regardless of their status, as well as guaranteed security in European borders.
